Terms of service.

EFFECTIVE MAY 12, 2026

These Terms of Service (the “Terms”) govern your access to and use of the OptimaVerifier service, websites, dashboards, and APIs (collectively, the “Service”) provided by Elka Technology Group LLC, trading as “OptimaVerifier” (“OptimaVerifier”, “we”, “us”). By creating an account, clicking “I agree”, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Your account

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately at security@optimaverifier.com if you suspect unauthorized access.

2. The Service

OptimaVerifier provides email address verification — we attempt to determine whether a given email address is deliverable, undeliverable, catch-all, or unknown using DNS lookups, SMTP probing, and related techniques. Verification results are probabilistic; we do not guarantee that any given result is correct or that an address will accept future mail.

3. Acceptable use

You agree not to:

  • Use the Service to harvest, scrape, or compile address lists without the addressees’ consent;
  • Send unsolicited bulk email (spam), or use the Service in furtherance of any unlawful marketing practice (including any practice that violates CAN-SPAM, GDPR, CASL, the UK PECR, or comparable laws);
  • Reverse-engineer, scrape, or extract substantial portions of the Service or its outputs beyond your own verification jobs;
  • Resell, sublicense, or white-label the Service without a separate written agreement;
  • Probe, attack, or otherwise interfere with the Service’s infrastructure, rate limits, or fraud-prevention measures.

We may suspend or terminate accounts that breach these rules, with or without notice, depending on the severity.

4. Subscriptions, billing, and trial credits

Paid plans renew automatically until cancelled. Pricing is shown on our plans page. New accounts receive 5,000 free trial credits to evaluate the Service; trial credits do not expire by time, but the credit allowance does not roll over once you start a paid plan.

Payments are processed by Paddle.com Market Limited (“Paddle”), which acts as the Merchant of Record for paid plans. By subscribing, you also agree to Paddle’s checkout buyer terms and (where invoiced) Paddle’s invoiced consumer terms. Paddle handles tax collection, invoicing, and refund processing on our behalf.

5. Cancellation and refunds

You may cancel your paid plan at any time from your billing dashboard. Cancellation stops the next renewal but does not retroactively refund the current cycle, except as set out in our Refund Policy, which forms part of these Terms.

6. Your data

Email addresses you submit for verification (the “Verification Data”) remain yours. We process Verification Data solely to deliver the Service and (where you have asked us to) to retain verification results on your behalf. Our handling of personal data is governed by our Privacy Policy.

You warrant that you have the lawful basis to submit each address you verify, and that doing so does not breach any agreement you have with the addressee.

7. Intellectual property

The Service, its design, source, documentation, and all related rights are owned by OptimaVerifier or its licensors. We grant you a non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms; nothing else is licensed by implication.

Verification results we return to you may be used internally and shared with your customers and counterparties for any lawful purpose, subject to the acceptable-use rules above.

8. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Verification results are estimates, not guarantees, and you remain responsible for your own sending practices, list hygiene, and compliance.

9. Limitation of liability

Nothing in these Terms excludes or limits any liability that cannot be excluded under applicable law (including liability for death or personal injury caused by negligence, or fraud). Subject to that:

  • Neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data;
  • Our total aggregate liability arising out of or in connection with these Terms is capped at the greater of (a) the fees paid by you to us in the twelve (12) months immediately preceding the event giving rise to the claim, and (b) US $100.

10. Termination

You may close your account at any time from Settings. We may suspend or terminate your access if you materially breach these Terms, fail to pay sums when due, or if we are required to do so by law. On termination, your right to use the Service ends and we may delete your account data after a reasonable wind-down window.

11. Changes to these Terms

We may update these Terms from time to time. If a change is material, we’ll notify you by email or in-product notice at least 14 days before it takes effect. Continued use after the effective date means you accept the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of Colorado and the applicable federal laws of the United States, without regard to conflict-of-laws principles. The state and federal courts located in Colorado shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms, except that consumers may bring claims in their country or state of residence to the extent local law requires.
